What is wrongful death?
Legally, wrongful death is defined as the death of an individual as a result of another party’s negligent actions. The “other party” may be another person, a group of people, or a company. In order for a wrongful death lawsuit to be successful in court, it needs to have the following four components:
- Death of an individual
- Death was caused by someone else’s negligence (or with their intent to cause damage)
- Surviving family or dependents suffering from monetary strains due to the loss
- Presence of a personal representative of the deceased’s estate
With these four components present, one may be able to bring to court a successful wrongful death case.
Medical Malpractice Causes of Wrongful Death
Individuals may suffer wrongful death due to medical malpractice. Common types of medical mistreatment that can lead to a wrongful death case include the following:
- Surgical malpractice/error
- Medication or pharmaceutical error
- Birth injury
- Diagnosis errors
People who have lost a loved one to one of the above forms of medical malpractice should seek damages for such mistreatment and suffering.
